This document governs the use of the Cedar Pumps Platform, the sale of products and services by Cedar Solar SA (Pty) Ltd ("Cedar Solar", "Cedar", "we", "us"), and explains how we collect, use, and protect personal information on our websites www.cedarsolar.com, cedarpumps.com, and beta.cedarpumps.com. By accessing our website, using the Platform, accepting a quotation, or purchasing any product or service, you agree to these Terms, Conditions, Warranty provisions, and Privacy Policy.
1. Definitions
1.1 "Cedar" means Cedar Solar SA (Pty) Ltd and its affiliates, including Cedar Pumps.
1.2 "Platform" means the website, web application, sizing tools, quoting systems, AI agents, reporting tools and associated services available at cedarpumps.com and related domains.
1.3 "User" means any person or entity accessing or using the Platform.
1.4 "Sizing Tool" includes all solar pump sizing, AC pump sizing, Veichi sizing, financial sizing and related calculation modules.
1.5 "AI Tools" means any automated decision-making, advisory or analytical tools made available on the Platform.
1.6 "CPA" means the Consumer Protection Act 68 of 2008.
1.7 "ECTA" means the Electronic Communications and Transactions Act 25 of 2002.
2. Acceptance of Terms
2.1 By accessing or using the Platform, using our website, accepting a quotation, or purchasing any product or service, the User agrees to be bound by these Terms and Conditions.
2.2 If the User does not agree, the User must immediately discontinue use of the Platform.
2.3 These Terms constitute a binding agreement in terms of South African law.
3. Nature of the Platform
3.1 The Platform provides automated sizing estimations, yield projections, financial illustrations, product recommendations, quoting functionality, and related commercial tools.
3.2 The Platform is a decision-support tool only.
3.3 The Platform does not constitute a certified engineering design, a professional electrical design, a hydrological assessment, financial advice, or a guaranteed performance commitment.
4. General Terms of Sale
• Quotations are valid for 14 days and subject to available stock.
• Prices are exclusive of VAT (15%) and may change without notice.
• Transport, delivery, installation, commissioning, insurance, and electrical work are excluded unless stated in writing.
• Orders may only be released once cleared payment reflects in Cedar Solar’s bank account.
• Order cancellations are subject to a 15% handling fee.
• Technical phone support is available Monday–Friday, 08:00–16:00.
• On-site technician visits require payment of a call-out fee in advance.
5. Ownership, Transport & Risk
Ownership and risk pass to the purchaser once goods leave Cedar Solar’s warehouse. Cedar Solar is not liable for loss, theft, or damage after this transfer, including where third-party couriers are used. Customers are responsible for arranging and paying for in-transit insurance. These conditions apply to all supplied goods.
6. Product Responsibility
Where Cedar Solar products form part of a larger installation, our warranty applies only to the Cedar Solar product itself and not to the overall system design, installation, or performance. Faults caused by external components, installation methods, or site conditions are excluded from responsibility.
7. Warranty Overview
Cedar Solar warrants products against defects in workmanship and materials for specified periods beginning from the invoice date. During the warranty period, Cedar Solar may repair, replace, or credit the defective product at its discretion. These remedies are the sole warranty remedies available.
8. Warranty Evaluation Process
Faulty products must be returned to Cedar Solar’s workshop for inspection before any claim is approved. Warranty approval depends solely on Cedar Solar’s technical findings. Customers who replace products before evaluation do so at their own risk.
9. Warranty Periods
Typical warranty periods include:
• Pump ranges (Spitfire, Ceva2, Uniflow, Multiflow): 24 months
• Swala pumps: 6 months
• Veichi drives: 12 months
• Discontinued premium pumps: 24 months support until June 2026
• Repairs outside warranty carry a 3-month repair warranty.
10. Warranty Limitations & Exclusions
Warranty does not cover: incorrect installation, electrical faults, misuse, sediment, debris, dry-running, overheating, cavitation, operation outside design limits, lightning, flooding, theft, vandalism, or other external damage, normal wear and tear, or non-approved components. Cedar Solar is not liable for direct, incidental, or consequential losses, including loss of income or production.
11. Installation & System Requirements
Warranty validity requires: correct water levels, cooling, mounting, and accessibility; qualified electrical installation and proper protection devices; use of approved Cedar Solar components; mandatory pump sleeves in tanks, dams, or rivers. Installations performed by Cedar Solar include a 12-month workmanship warranty. Third-party installations are excluded from performance liability.
12. Returns Policy
Returns allowed within 14 days and subject to handling fees. Cut cables, fuses, batteries, and special-order items are non-returnable.
13. Friction Loss Disclaimer
13.1 The friction loss calculator provides broad engineering guidance only.
13.2 The calculations do not incorporate minor losses arising from fittings, bends, valves, reducers, strainers, couplings or other hydraulic components; do not account for pipe roughness changes over time; and assume steady-state flow conditions.
13.3 For Solar Pump Sizing: the pipe diameter input refers to the internal diameter of the pipe.
13.4 For AC Pump Sizing: the internal pipe diameters used in calculations are derived from relevant local manufacturing reference data. Actual internal diameters may differ between manufacturers.
13.5 The internal diameter used in calculations is displayed in the sizing report and must be verified against the installed pipe specifications.
13.6 Cedar accepts no liability for discrepancies arising from manufacturer-specific pipe variations, incorrect pipe class selection, incorrect internal diameter assumptions, or installation deviations.
14. Voltage Loss Disclaimer
14.1 The voltage loss calculator is based on steady-state assumptions using impedance values derived from AS/NZS 3008 reference data for copper multi-core PVC V-90 cables with 75°C conductor temperature under standard installation conditions.
14.2 The calculations assume sinusoidal supply, nominal system voltage, one-way cable length, constant operating current, and worst-case impedance (|Z|) methodology.
14.3 The tool does not account for motor starting currents, harmonic distortion, voltage imbalance, ambient temperature variation, installation derating factors, conduit grouping, burial depth, altitude, parallel conductors, transformer impedance, fault levels, or current-carrying capacity compliance.
14.4 The results are for guidance purposes only and do not constitute a certified electrical design.
14.5 Final cable selection, regulatory compliance and safety verification remain the responsibility of a qualified electrical professional.
15. Climate Data Disclaimer
15.1 Climate and irradiance data are derived from publicly available NASA datasets for limited historic periods.
15.2 The data represents non-exhaustive historical trends only and does not warrant or guarantee future irradiance levels, current weather conditions, seasonal consistency, drought conditions, or cloud cover variability.
15.3 The data is provided solely as a guideline for possible irradiance production in a geographic area.
15.4 Cedar shall not be liable for deviations between projected and actual solar yield.
16. Sizing Tool Disclaimer
16.1 Model selection and yield projections are based exclusively on user-provided inputs, embedded algorithmic assumptions, and historical datasets.
16.2 Cedar shall not be liable for incorrect sizing arising from inaccurate or incomplete user inputs, incorrect water level data, borehole recovery variability, pipe specification errors, electrical installation deviations, algorithmic limitations, or computational errors.
16.3 The User must independently verify product suitability and expected yield output.
17. User Responsibilities
17.1 Accuracy of Information: The User warrants that all information entered into the Platform is accurate and complete. Cedar does not independently verify user inputs. Any incorrect input invalidates the output and recommendations.
17.2 Professional Installation: All installations must be performed by suitably qualified professionals. Failure to comply with applicable regulations, standards or codes voids any reliance on the Platform outputs.
18. AI Tools Disclaimer
18.1 AI-generated recommendations are automated computational outputs. They do not constitute professional engineering advice, certified electrical assessments, financial advice, or warranty determinations.
18.2 AI-generated technical assessments are preliminary only and subject to human review.
18.3 Cedar reserves the right to override or amend any AI output.
19. Financial & ROI Disclaimer
19.1 Financial projections, savings illustrations and PAYGO models are indicative only.
19.2 They do not constitute financial advice or guarantees of savings.
19.3 Energy price escalation assumptions may vary from actual future tariffs.
19.4 The User bears full responsibility for financial decisions.
20. Pricing
20.1 All prices are subject to change without notice.
20.2 Quotes are subject to stock availability and final confirmation.
20.3 Pricing visibility may vary based on account type, territory or reseller tier.
20.4 Cross-territory pricing access is restricted.
21. Limitation of Liability
21.1 To the maximum extent permitted by law, Cedar’s total aggregate liability shall not exceed the lesser of: the total amount paid by the User to Cedar in the preceding 12 months; or R10,000 where no payment has been made.
21.2 Cedar shall not be liable for loss of profit, crop loss, livestock loss, production loss, water shortage damage, consequential damages, or indirect damages.
21.3 Nothing in these Terms limits rights under the CPA that may not lawfully be excluded.
22. Indemnity
The User indemnifies Cedar against any claims arising from incorrect installation, regulatory non-compliance, misuse of products, incorrect system integration, or reliance on automated outputs without professional verification.
23. Third-Party Data & Services
23.1 Cedar integrates with third-party systems including payment gateways, logistics providers, ERP systems and supplier APIs.
23.2 Cedar does not warrant continuous availability, accuracy of synchronised data, or real-time stock reliability.
23.3 Cedar shall not be liable for third-party downtime or errors.
23.4 Third-party advertising partners may use cookies, JavaScript, or web beacons to personalise advertising and measure campaign effectiveness. Cedar has no control over third-party cookies. Users may disable cookies via browser settings.
24. Intellectual Property
24.1 All algorithms, flow databases, climate modelling processes, financial models and AI logic are proprietary to Cedar.
24.2 Reverse engineering, scraping or data extraction is prohibited.
25. Data & Privacy (POPIA Compliance)
Cedar respects your privacy and complies with the Protection of Personal Information Act (POPIA).
25.1 Information We Collect: Name, contact details, business information; IP address, browser type, ISP, timestamps, referring pages; website usage analytics and cookies. This information is not linked to personally identifiable data unless voluntarily provided.
25.2 How We Use Information: Quotations, communication, service delivery, website analytics and improvement, and legal compliance and record-keeping. By accepting a quotation or using our website, you consent to this processing.
25.3 Anonymised Data: Cedar may use anonymised, aggregated data for analytics and platform improvement. Users retain ownership of submitted data.
25.4 Children’s Information: Cedar does not knowingly collect personal data from children under 13. If such data is identified, it will be removed promptly upon notification.
25.5 Online-Only Scope: This privacy policy applies only to online activities on www.cedarsolar.com, cedarpumps.com, and beta.cedarpumps.com and not to offline data collection or third-party channels.
26. Modification & Termination
26.1 Cedar may modify the Platform or these Terms at any time.
26.2 Cedar may suspend or terminate accounts without notice where misuse occurs.
27. Governing Law & Jurisdiction
27.1 These Terms are governed by the laws of the Republic of South Africa.
27.2 The courts of the Western Cape shall have jurisdiction, without prejudice to Cedar's right to approach any court of competent jurisdiction.
27.3 Parties shall attempt mediation before litigation.
27.4 Cedar may recover legal costs on an attorney-and-own-client scale in cases of default.
28. Severability
If any provision is found invalid or unenforceable, the remaining provisions remain fully enforceable.
29. CPA Compliance
Nothing in these Terms is intended to limit any consumer rights that may not lawfully be excluded in terms of the Consumer Protection Act 68 of 2008.
